Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Rider," or "Driver Partner") and Bitdrive Technologies Pvt. Ltd. ("Bitdrive," "we," "us," or "our"), governing your access to and use of the Bitdrive StarRide platform, including our mobile applications, website at bitdrive.in, and all associated services.

By creating an account, booking a ride, accepting a trip request as a driver, or simply browsing our platform, you acknowledge that you have read, understood, and agree to these Terms. Your continued use constitutes ongoing acceptance of any updates to these Terms.

To access and use the Bitdrive platform, you must meet the following eligibility requirements:

• You must be at least 18 years of age or older.
• You must possess a valid and current mobile number registered in India.
• You must provide accurate, truthful, and complete registration information.
• Your account must not have been previously terminated by Bitdrive for policy violations.
• You must comply with all applicable local, state, and national laws while using the platform.

When you request a ride through the Bitdrive platform, you are initiating a request for transportation services. The following conditions apply to all bookings:

1. Ride requests are subject to vehicle and driver availability in your area at the time of booking.
2. The fare displayed at the time of booking is an estimate; final charges may vary based on actual distance, time, and applicable surcharges.
3. You are responsible for being at the designated pickup location at the scheduled time. Waiting charges apply after the grace period.
4. Bitdrive acts as a technology platform connecting riders with independent driver partners. We do not provide transportation services directly.
5. Riders must not request rides for others without their consent, and must not use rides for illegal purposes or transportation of prohibited items.
6. In-ride conduct must be respectful. Bitdrive reserves the right to suspend accounts based on driver or co-passenger complaints.

All fares on the Bitdrive platform are calculated based on a combination of base fare, per-kilometre rate, time charges, and applicable taxes. The following table outlines the fare structure:

Payments may be made via UPI, debit/credit card, net banking, or Bitdrive Wallet. Cash payments may be available at driver discretion for select categories. All digital transactions are processed through PCI-DSS compliant payment gateways.

Driver Partners on the Bitdrive platform operate as independent contractors, not employees of Bitdrive. By registering as a Driver Partner, you agree to the following obligations:

• Possess a valid commercial driving licence (Badge) issued by the relevant RTO for the vehicle category you operate.
• Maintain the registered vehicle in roadworthy condition, including valid insurance, PUC certificate, and fitness certificate.
• Complete the Bitdrive driver onboarding verification, including police verification and background check.
• Maintain a minimum rating of to remain active on the platform. Accounts falling below this threshold will undergo a review process.
• Not operate under the influence of alcohol, narcotics, or any substance that impairs driving ability.
• Follow all traffic laws, wear seatbelts, and ensure the safety of passengers at all times.
• Not share, sell, or allow others to operate your Bitdrive driver account under any circumstances.

Bitdrive collects, stores, and processes personal data in accordance with our Privacy Policy and the applicable provisions of the Personal Data Protection Bill, 2023 and Information Technology Act, 2000.

Data we collect includes, but is not limited to: name, mobile number, email address, payment details, GPS location during rides, device identifiers, and in-app behaviour. This data is used to facilitate ride matching, process payments, improve service quality, and comply with legal obligations.

• Location data is collected only while the app is in use or a ride is active, unless you have granted background location permission.
• Your data is never sold to third parties for marketing purposes.
• You may request deletion of your account and associated data by contacting our support team.
• Bitdrive may share data with law enforcement agencies when required by a valid court order or legal process.

To the maximum extent permitted by applicable law, Bitdrive shall not be liable for indirect, incidental, special, consequential, or punitive damages including loss of profits, goodwill, data, or other intangible losses. Our aggregate liability shall not exceed the amount paid by you for services in the six months preceding the claim.

Bitdrive does not warrant that the platform will be uninterrupted, error-free, or free of viruses. We are not responsible for ride delays caused by traffic conditions, weather, road closures, or driver availability beyond our reasonable control.

The following activities are strictly prohibited on the Bitdrive platform and may result in immediate account suspension, legal action, or both:

1. Using the platform to transport illegal goods, narcotics, weapons, or hazardous materials of any kind.
2. Harassing, threatening, abusing, or discriminating against drivers, riders, or Bitdrive staff based on gender, religion, caste, nationality, or any other characteristic.
3. Attempting to reverse-engineer, scrape, hack, or otherwise tamper with the Bitdrive platform or its infrastructure.
4. Providing fraudulent reviews, manipulating ratings, or gaming incentive systems through coordinated actions.
5. Creating fake accounts, impersonating other users, or misrepresenting your identity in any way.
6. Using the platform for purposes other than legitimate personal or business transportation needs.
7. Soliciting personal contact information from drivers or riders outside the platform for commercial gain.
8. Making false emergency reports, fraudulent refund claims, or dishonest trip disputes.

Bitdrive reserves the right to modify, update, or replace these Terms at any time. When we make material changes, we will notify you through the app, via email, or by updating the "Last Updated" date at the top of this page. Your continued use of the platform after such changes constitutes your acceptance of the revised Terms.
