Important Legal Notice: This Legal Information page sets out the corporate, regulatory, and intellectual property framework under which Bitdrive StarRide operates. It should be read alongside our Terms & Conditions and Privacy Policy. Access to and use of our platform constitutes acceptance of all legal notices contained herein.

Intermediary Status: Bitdrive Technologies Pvt. Ltd. operates as an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000. We provide a technology platform connecting riders with independent driver partners and do not directly provide transportation services.

PLATFORM DISCLAIMER
Scope and nature of our service

The Bitdrive StarRide platform, including its mobile applications, website, APIs, and all related digital infrastructure, is provided on an "as is" and "as available" basis. Bitdrive makes no warranties, express or implied, regarding the reliability, accuracy, fitness for purpose, or uninterrupted availability of the platform.

While we strive to maintain the highest levels of service quality, we expressly disclaim all warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Bitdrive is a technology intermediary only. We do not employ drivers, own vehicles used for rides, or guarantee the conduct of any driver partner. All transportation services are rendered by independent driver partners who are not agents or employees of Bitdrive Technologies Pvt. Ltd.
  • We do not guarantee that the platform will be free from errors, bugs, interruptions, or security vulnerabilities at all times.
  • We do not guarantee the accuracy of estimated arrival times, fare estimates, or route calculations as these depend on real-time factors beyond our control.
  • We reserve the right to suspend, modify, or discontinue any part of the platform at any time, with or without notice, for maintenance, updates, or operational reasons.
  • Content on the platform, including fare information and driver ratings, is for informational purposes only and may not always reflect the most current data.

INTELLECTUAL PROPERTY
Ownership of content, brand, and technology

All intellectual property associated with the Bitdrive StarRide platform is exclusively owned by Bitdrive Technologies Pvt. Ltd. or its licensors, and is protected under applicable Indian and international intellectual property laws.

Trademarks "Bitdrive", "Bitdrive StarRide", the Bitdrive logo, and associated marks are registered trademarks. Unauthorised use is strictly prohibited.
Software & Code All source code, algorithms, and software powering the Bitdrive platform are proprietary and protected by copyright law.
Design & UI The visual design, user interface, icons, illustrations, and design system of the platform are copyright protected works owned by Bitdrive.
Platform Data Aggregated and anonymised data generated by the platform, including ride patterns and demand analytics, is proprietary data owned by Bitdrive.
Permitted Use: Users are granted a limited, non-exclusive, non-transferable, revocable licence to use the Bitdrive platform solely for its intended purpose of booking rides. No licence is granted to copy, reproduce, distribute, modify, or create derivative works of any Bitdrive intellectual property.

Any unauthorised use, reproduction, or distribution of Bitdrive's intellectual property — including scraping, reverse engineering, or creating competing products using our data or design — will be pursued vigorously through all available legal remedies, including injunctions and claims for damages.

LIMITATION OF LIABILITY
Caps on our financial and legal responsibility

To the maximum extent permitted under applicable Indian law, Bitdrive Technologies Pvt. Ltd., its directors, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.

This limitation applies regardless of the legal theory on which the claim is based, including but not limited to contract, tort, negligence, strict liability, fraud, or any other legal or equitable theory, even if Bitdrive has been advised of the possibility of such damages.

Aggregate Liability Cap: In all cases, Bitdrive's total aggregate liability to any individual user for any claim arising out of or relating to the platform shall not exceed the total amount paid by that user to Bitdrive in the six (6) calendar months immediately preceding the event giving rise to the claim.

THIRD-PARTY LINKS & SERVICES
External services integrated into our platform

The Bitdrive platform integrates and may contain links to third-party services, applications, APIs, and websites. These third-party integrations are necessary to deliver core functionality and an enhanced user experience. However, Bitdrive does not endorse, control, or assume responsibility for the content, privacy practices, or reliability of any third-party services.

Google Maps Platform Used for navigation, geocoding, ETA calculations, and route display. Subject to Google's Terms of Service and Privacy Policy.
Payment Gateways Razorpay and Cashfree process all transactions. These gateways operate under their own RBI-compliant terms and PCI-DSS certification.
SMS & Communication Twilio and MSG91 are used to deliver OTPs, ride alerts, and support messages. These providers maintain their own data processing agreements.
Analytics & Monitoring Firebase and Sentry are used for app performance monitoring, crash reporting, and anonymised usage analytics on an aggregated basis.

By using the Bitdrive platform, you acknowledge that your interactions with third-party services embedded in the platform are governed by those services' own terms and privacy policies. Bitdrive is not responsible for any data handling, service failures, or disputes arising from third-party services.

INDEMNIFICATION
Your responsibility to protect Bitdrive from claims

You agree to defend, indemnify, and hold harmless Bitdrive Technologies Pvt. Ltd., its subsidiaries, affiliates, directors, officers, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees — including reasonable legal fees — arising out of or relating to:

  1. Your violation of these legal terms, our Terms & Conditions, or our Privacy Policy.
  2. Your use or misuse of the Bitdrive platform in a manner inconsistent with its intended purpose.
  3. Your violation of any third-party rights, including intellectual property rights, privacy rights, or contractual rights.
  4. Any false, misleading, or fraudulent information you provide to Bitdrive or to other users through the platform.
  5. Any content you submit, post, or transmit through the platform that causes harm to a third party or violates any applicable law.
  6. Your conduct during any ride, including but not limited to damage to a driver's vehicle, injury to any person, or violation of traffic laws.
Notification of Claims: Bitdrive will promptly notify you of any claim subject to indemnification. You agree to cooperate fully with Bitdrive in the defence of such claims. Bitdrive reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to indemnification by you.

REGULATORY COMPLIANCE
Laws and regulations we operate under

Bitdrive Technologies Pvt. Ltd. is committed to operating in full compliance with all applicable Indian laws, regulations, and guidelines. The following statutory frameworks govern our operations:

IT Act, 2000 & IT Rules, 2021 We comply fully with the Intermediary Guidelines and Digital Media Ethics Code Rules, 2021 including the appointment of a Grievance Officer.
Payment & Settlement Systems Act All payment processing complies with RBI guidelines for payment aggregators and the Payment and Settlement Systems Act, 2007.
Motor Vehicles Act, 1988 All driver partners on the platform are required to hold valid licences and comply fully with the Motor Vehicles Act, 1988 and Kerala Motor Vehicles Rules.
Consumer Protection Act, 2019 We comply with the Consumer Protection (E-Commerce) Rules, 2020, including clear grievance redressal mechanisms and transparent pricing.
Personal Data Protection Bill, 2023 All personal data handling complies with the PDPB 2023 framework including data minimisation, purpose limitation, and user rights.
GST & Income Tax Laws All applicable GST, TDS, and income tax obligations under the Income Tax Act, 1961 and CGST/SGST Acts are duly complied with.
Grievance Officer: As required under Rule 3(2) of the IT (Intermediary Guidelines) Rules, 2021, Bitdrive has appointed a Grievance Officer. Grievances can be submitted at grievance@bitdrive.in and will be acknowledged within 24 hours and resolved within 15 days.

FORCE MAJEURE
Events beyond our reasonable control

Bitdrive shall not be held liable for any failure or delay in performance of its obligations under these terms where such failure or delay is caused by circumstances beyond its reasonable control (Force Majeure Event).

Force Majeure Events include but are not limited to:

  • Acts of God, including earthquakes, floods, cyclones, lightning, fire, or other natural disasters.
  • Epidemic, pandemic, or public health emergency declared by a competent government authority.
  • War, riot, civil unrest, terrorism, sabotage, or acts of a hostile government entity.
  • Nationwide or widespread power grid failures, telecommunications outages, or internet infrastructure disruptions.
  • Actions, orders, or regulations issued by any governmental, regulatory, or judicial authority that prevent Bitdrive from fulfilling its obligations.
  • Large-scale cyberattacks, DDoS attacks, or malicious code attacks on Bitdrive's infrastructure that could not have been reasonably prevented.
  • Widespread strikes, lockouts, or industrial action affecting Bitdrive's service providers or communications infrastructure.
Notification: In the event of a Force Majeure Event, Bitdrive will use reasonable efforts to notify users promptly, resume services as quickly as possible, and provide any applicable service credits or refunds for pre-paid bookings that could not be fulfilled due to the event.

GOVERNING LAW & DISPUTES
Jurisdiction, arbitration, and dispute resolution

These legal terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of India. The following dispute resolution framework applies:

Step 1 — Direct Resolution All disputes must first be submitted in writing to legal@bitdrive.in. Bitdrive will respond within 15 business days with a proposed resolution.
Step 2 — Mediation If direct resolution fails within 30 days, both parties agree to attempt resolution through a mutually agreed certified mediator before pursuing arbitration.
Step 3 — Arbitration Unresolved disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Ernakulam, Kerala.
Jurisdiction For matters not subject to arbitration, the courts of Ernakulam, Kerala shall have exclusive jurisdiction over all disputes.
Class Action Waiver: To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration against Bitdrive.

How to send formal notices and reach our legal team

All formal legal notices, complaints, or communications intended to have legal effect must be sent in writing to Bitdrive Technologies Pvt. Ltd. via one of the channels below. Notices sent by email are deemed received on the next business day. Notices sent by registered post are deemed received 3 business days after posting.
